1. Agreement to Terms
By accessing or using Auto Shop Guru (the "Service"), you agree to be bound by these Terms and Conditions (the "Terms"). If you do not agree, do not use the Service.
2. The Service
Auto Shop Guru provides a web-based Price Matrix Optimizer for parts-based automotive shops. You upload sales data (CSV) from your shop management system (currently Tekmetric), set a profit target, and the Service returns a tier-by-tier recommended price matrix.
The Service may also offer paid consulting calls (the "Expert Calls") delivered remotely by Auto Shop Guru personnel or contractors.
3. Pricing and Payment
Each Price Matrix unlock is a one-time charge of $49.00 USD. Each three-call expert package is $250.00 USD. Payment is processed through Stripe. By submitting payment, you authorize Stripe to charge the payment method you provide.
A single unlock entitles you to view, export, and download one (1) full Price Matrix result during the active browser session in which the payment was made. The unlocked result is not retained after the session ends. The consent checkbox on the unlock screen confirms that you understand this.
4. No Refunds
All sales are final. We do not offer refunds, partial refunds, credits, or exchanges for any reason, including but not limited to: failure to export your results before closing the page, dissatisfaction with the recommended matrix, or accidental purchase. By completing payment, you waive any right to chargeback for the foregoing reasons.
5. License and Acceptable Use
We grant you a personal, non-exclusive, non-transferable, non-sublicensable license to use the Service for the operation of your own auto shop. You may not:
- Resell, sublicense, or redistribute the Service or its output.
- Reverse engineer, decompile, or scrape the Service.
- Use the Service to provide pricing services to third parties as a commercial offering without our written consent.
- Upload data you do not have the right to use.
- Interfere with or attempt to circumvent the paywall.
6. Your Data
You retain all rights to the sales data you upload. The Service processes your data on its servers to compute the Price Matrix. We do not retain a copy of your raw sales data after your session ends. Please review our Privacy Policy for details.
7. No Warranty
The Service is provided "as is" and "as available," without warranties of any kind, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, non-infringement, or accuracy of results. The recommended price matrix is a data-driven suggestion, not a guarantee of revenue or profit outcomes. Your business results depend on factors outside of our control.
8. Limitation of Liability
To the maximum extent permitted by law, in no event shall Auto Shop Guru, its owners, employees, or affiliates be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to lost profits, lost data, or business interruption, arising from or related to your use of the Service. Our total cumulative liability to you for any claim arising from the Service shall not exceed the amount you paid to us in the twelve (12) months preceding the claim.
9. Indemnification
You agree to defend, indemnify, and hold harmless Auto Shop Guru from and against any claims, liabilities, damages, losses, and expenses arising out of or related to your use of the Service, your violation of these Terms, or your violation of any third-party rights.
10. Termination
We may suspend or terminate your access to the Service at any time, with or without notice, for any reason, including violation of these Terms. Provisions that by their nature should survive termination (including Sections 4, 7, 8, 9, and 11) will survive.
11. Governing Law
These Terms are governed by the laws of the United States and the state in which the Service is operated, without regard to its conflict of laws rules. Any disputes shall be resolved in the courts of that state.
12. Changes to These Terms
We may update these Terms from time to time. The "Last updated" date at the top of this page reflects the latest revision. Continued use of the Service after changes constitutes acceptance of the updated Terms.
